Terms of Service

Last updated: 30 August 2026

In short

TheBestOfYou is a free calorie and fitness tracking app. It is an information tool, not a medical device: its calorie, macro and workout figures are estimates and must not be used as medical advice. Use the app sensibly, keep your account details safe, and delete your account at any time.

Accepting these terms

By creating an account or using TheBestOfYou you accept these terms. If you do not agree with them, please do not use the service. The service is provided by the app developer as an individual, based in Hungary, reachable at the address at the bottom of this page.

Who may use it

You must be at least 16 years old to create an account. If you are under 18, please use the service with the involvement of a parent or guardian. One person may hold one account, and the information you enter about yourself should be accurate, because your calorie and macro targets are calculated from it.

Not medical advice

This is the most important section of these terms. TheBestOfYou does not provide medical, dietary or health advice, and no part of the app is a diagnosis, a treatment or a professional recommendation. Calculated calorie needs, macro targets, BMI, burned energy and similar figures are estimates produced from general formulas, and can differ substantially from your actual needs.

  • Consult a doctor or a dietitian before starting a diet or a training plan, particularly if you are pregnant or breastfeeding, are being treated for an illness, take medication, or have or have had an eating disorder.
  • Do not use the app to set extreme calorie deficits or to sustain disordered eating.
  • Stop exercising and seek medical help if you feel unwell.

AI features and their limits

The app can recognise meals from a photo or a written description, and answer questions through an assistant. These features use automated models and are frequently inaccurate: portion sizes, ingredients and nutritional values are estimates that you should check and correct. Nutritional data also comes partly from Open Food Facts, a community database whose entries may be incomplete or wrong. Never rely on these figures where a mistake could matter to your health, for example when counting carbohydrates for insulin dosing or when avoiding an allergen.

Your account

You are responsible for your password and for everything done through your account. Please tell us promptly if you suspect someone else has gained access. Accounts may be suspended or deleted if they break these terms, are used to damage the service, or appear to be fraudulent.

Acceptable use

Use the service for your own personal, non-commercial purposes. You agree not to:

  • break the service, place a disproportionate load on it, or bypass rate limits
  • access other users data, or probe the service for vulnerabilities without permission
  • scrape or bulk-copy the food database, or resell the service
  • upload unlawful, offensive or infringing content, including photographs of other people without their consent
  • use the app in a way that breaks the law or infringes anybody rights

Content you add

You keep ownership of what you enter: your meals, workouts, weight history and photographs. Photographs sent for analysis are processed to produce the entry and are not published. Foods and recipes you submit to the shared database may be reviewed and made available to other users, so please only submit information you are entitled to share. You grant permission to store and process your content for the purpose of operating the service.

MCP access

The app can issue a token that lets an AI assistant of your choice read your data and create entries on your behalf. That token acts as a key to your account: keep it private, connect it only to tools you trust, and revoke it in the settings when you no longer need it. Actions taken through a tool you connected count as your own.

Availability and changes

The service is free and provided as it is, without any guarantee of availability, accuracy or fitness for a particular purpose. It may be interrupted, changed or discontinued, and features may be added or removed. If the service were ever shut down, notice would be given in good time so that you can export or delete your data.

Liability

To the extent permitted by law, no liability is accepted for indirect or consequential loss arising from use of the service, for decisions taken on the basis of its estimates, or for data loss caused by circumstances outside our control. Nothing in these terms limits liability for damage caused intentionally, or for harm to life, physical integrity or health, as Hungarian law does not permit such limits.

Ending your use

You may stop using the service and delete your account at any time, from the settings in the app or by writing to the address below. Deleting your account removes your personal data as described in the privacy policy.

Changes to these terms

These terms may be updated, for example when features change or the law requires it. Substantial changes will be announced in the app or by email before they take effect. Continuing to use the service after that means you accept the new terms.

Governing law

These terms are governed by Hungarian law. If you are a consumer, this does not deprive you of the protection of mandatory rules in your country of residence. Please raise any dispute with us directly first, because most matters are settled quickest that way.
